This Enrollment Agreement (hereinafter, “agreement”) is effective upon the date of execution and is made between the  Parent/Legal Guardian(s) (hereinafter, “parent/guardians”) of [learner name] (hereinafter, “learner”) and Roots & Wings Academy/RWA for the 2025-2026 academic year and is subject to the following terms:
 
 A. ANNUAL PROGRAM ENROLLMENT FEES
Financial Responsibility: In consideration of acceptance of this enrollment agreement by RWA, the parents/guardians accept responsibility for RWA's Annual Program Enrollment Fee, including incidental expenses. Parents/guardians understand that if enrollment is cancelled before the end of the academic year, there will be a cancellation fee equal to 50% of the remaining annual program enrollment fee owed for that academic year. This will provide compensation for financial losses incurred as a result of the cancellation.

B. BILLING

For the 2025-26 school year, the Annual Enrollment Fee for full-time LEGACY students is $8,490.00. A non-refundable $500.00 deposit is due at the time of registration. The balance of $7,990.00 can be paid in ten (10) monthly installments of $799.00 from August 1, 2025 to May 1, 2026.

 Payment Schedule: Monthly tuition is billed in advance and due in FULL by the 1st of each month.  This payment option includes 10 monthly installments from August 2025 to May 2026.

Late Fees:  Our program's success relies upon timely payments to ensure sustainable operation.  

· After 3 days, a 10% late fee will be applied.

· After 10 days, a 15% late fee will be applied.

 In addition to the Registration Fee, we require an additional $350.00 Enrichment Fee.

 Payment remains due in full, regardless of absences due to illness or vacation, as our calendar and scheduled breaks are factored into these costs. Special exceptions require written approval from the RWA Board of Directors.

Credit Card: A 3.5% processing fee will apply for credit card payments.

Outstanding Balances
Roots & Wings Academy reserves the right to deny attendance, prohibit participation in activities, internships and/or events, or withhold RWA Growth Reports and/or transcripts if there is an outstanding balance.
 
 C. CANCELLATIONS
If there are circumstances requiring [Learner’s] withdrawal, the entire deposit and any other payments already received will be forfeited. If parents/guardians notify RWA in writing by August 31 st , 2025, the remaining annual program enrollment fee balance for the 2025-2026 academic year, minus the deposit and any other payments already received, will be waived. Inasmuch as enrollment is made for the entire academic year and budgeted accordingly, parents/guardians will owe the deposit and 50% of the Annual Program Enrollment Fee balance for the current academic year if [learner name] is withdrawn from RWA after October 31, 2025.

D. TERMINATIONS, SUSPENSIONS, MODIFICATIONS:
1. Parents/guardians agree to comply with expectations as set forth in the Family & Learner Handbook and any and all health and safety policies instituted by RWA, including any state-mandated requirements. Parents/guardians agree on behalf of themselves and the enrolled learner to abide by the rules, regulations, and requirements of Roots & Wings Academy as from time to time made known outside of the Family & Learner Handbook.
 2. Roots & Wings Academy may terminate this contract, suspend [Learner], or modify [Learner’s] participation in the program if the Director(s) of RWA, determine(s) that: a. The learner is unable to participate in and benefit from group instruction and comply with the program’s standard for behavior and Code of Conduct as outlined in the Family & Learner Handbook. b. Parents’/Guardians’ continued involvement with the program is not in the best interest of the learner or Roots & Wings Academy. Parents/guardians understand that, to operate effectively, Roots & Wings Academy must have a positive relationship with the learner and the parents/guardians of the learner – built on mutual trust, respect, and cooperation. Roots & Wings Academy reserves the right to dismiss any learner whose behavior or lack of cooperation is deemed unacceptable or whose parents/guardians no longer have a cooperative relationship with Roots & Wings Academy.
 3. If Roots & Wings Academy terminates on or before October 31, 2025, the annual program enrollment fee balance for the 2025-2026 academic year, minus the deposit and any other payments already received, will be waived. Inasmuch as enrollment is made for the entire academic year and budgeted accordingly, parents/guardians will owe the deposit and 50% of the Annual Program Enrollment Fee balance if [Learner name] is withdrawn from RWA after October 31, 2025.
 
 E. INDEMNIFICATION:
Parents/caregivers recognize that children may get hurt at RWA or while engaging in learner activities. Parents/guardians release Roots &Wings Academy from any and all liability for or related to any accident, actions, suits, or claims that occur in connection with program activities either on or off RWA grounds other than as a result of gross negligence by Roots & Wings Academy, its’ agents, or employees. Parents/caregivers release, indemnify, and hold harmless Roots & Wings Academy, its trustees, agents, and employees from any and all claims, damages, and other liability for injury or illness to the learner or damage to learner property where such claims, damages, or other liability are not the result of gross negligence by the RWA, its agents, or employees.

F. FORCE MAJEURE
Roots & Wings Academy reserves the right, in its sole discretion, to suspend its duties and obligations, under this Contract or otherwise, immediately without notice, during periods that RWA is closed because of force majeure events. This includes, but is not limited to, any fire, act of God, war, governmental action, act of terrorism, epidemic, pandemic, natural disaster, or any
other event that is beyond the RWA’s control. If such an event occurs, the duties and obligations in this contract will be postponed until such time as Roots & Wings Academy, in its sole discretion, may safely reopen. Roots & Wings Academy may also alter its calendar or provide alternate means of instruction as necessary.

G. HEALTH
Parents/guardians agree to comply with the following prior to their child attending RWA:
1. Submit a current physical examination with proof of updated immunizations, as required by law or proof of religious or medical exemption acceptable to the NJ Department of Health.
2. Comply with the RWA’s policies regarding communicable diseases and any required testing.
3. Provide current information regarding allergies, medications, and [Learner’s] health needs.
4. Provide authorization for Roots & Wings Academy to contact [Learner’s] physician in the event of an emergency.

Failure to comply with the requirements set forth above will not release parents/guardians from their financial obligations under this contract.

ACCEPTANCE OF CONTRACT
Parents/guardians of [Learner] are jointly and severally liable for the Annual Program Enrollment Fee. By signing this contract, the parents/guardians confirm they have read this contract, understand, accept, and agree to be bound by all of its terms and conditions, which cannot be changed except with the express written consent of both parties. This contract agreement will be interpreted in accordance with the laws of the State of New Jersey.
